Terms & Conditions
General Terms and Conditions of <OPERATOR> for Participation in Sports Betting in <country/state> (Version x.y, as of: xx.xx.20xx)
- General Section
- Preliminary remark
<OPERATOR> (hereinafter also referred to as <abbreviations>, <alias>) is a company incorporated under the laws of <country/state> with its registered office at <address>, <country/state>. The company was incorporated on <date> under company number <VAT no.>. By virtue of the licence granted by the <authority>, <ref. no.>, <OPERATOR> is authorised as an officially licensed sports betting operator to organise sports betting on the internet and terrestrially. <OPERATOR> is under the supervision of the <authority>.
<OPERATOR> offers the conclusion of bets on the occasion of sporting events (hereinafter "sports betting") for its customers under the <brand name> brand. In this context, <OPERATOR> accepts bets via intermediaries integrated into its sales organisation (hereinafter "betting shops") as well as via its website <URL> and the mobile <brand name> apps (hereinafter summarised in simplified form under the term "website"). These GTC apply exclusively to participation in sports betting offered and organised by <OPERATOR>.
By opening a customer account, using a customer account or placing or participating in the bets offered (hereinafter "<OPERATOR>offers" or "use of <OPERATOR> offers"), the customer (hereinafter also "betting customer", "player" or "you") declares that he/she understands and accepts these General Terms and Conditions (hereinafter "GTC"), all betting and other rules as amended from time to time, as well as the <OPERATOR> Data Protection Policy in their entirety and agrees to comply with them.
Employees of <OPERATOR> and affiliated companies as well as intermediaries integrated into the sales organisation of <OPERATOR>and their employees are prohibited from using the <OPERATOR> offers.
These T&Cs, all betting and other rules, as well as the <OPERATOR> Privacy Policy, are subject to change at any time. You will be notified of any changes by email and/or pop-up window when you use the <OPERATOR> offers on the website. These changes will take effect once you have accepted them and will then apply to all subsequent bets placed. In the event that you reject or object to the changes, further use of the <OPERATOR> Offers will no longer be possible. Before using the <OPERATOR> offers in a betting shop, you are responsible for viewing and taking note of the respective valid GTC.
The services and products offered by <OPERATOR> may be changed or discontinued at any time.
- Conclusion of a betting contract
- A betting contract between the betting operator and the betting customer is concluded when an application submitted by a customer to place a bet has been accepted by <OPERATOR> (for the acceptance of an application to place a bet, see section 2.e. below). A betting customer is only entitled to submit an application for the conclusion of a bet to the betting operator if he/she has a corresponding credit balance on the customer account or has paid the corresponding bet in cash in the betting shop. Betting applications via other channels than a betting shop or the website are not permitted and will not be accepted. The betting shop may neither make nor receive declarations of intent on behalf of <OPERATOR>. In particular, the betting shop is prohibited from changing or otherwise influencing betting odds of the betting operator. All applications for the conclusion of betting contracts submitted in the Betting Shop or on the Website shall be organised, received, placed and processed exclusively in <country/state> (see clause 2.e. below). The place of conclusion of each betting contract is <country/state>.
- <OPERATOR> is entitled, at any time and without specifying reasons, to refuse to accept individual bets, to limit the wager amount before accepting bets, and/or to change odds prior to accepting a bet. <OPERATOR> may also, at its own discretion, set binding odds and payout or winnings limits for the betting customer or exclude individual customers from participation without specifying the reasons for such exclusion.
- By opening a customer account and/or submitting an application to conclude a betting contract, you declare and affirm that you
-
- have reached the age of 18,
- are not a person with limited legal capacity, in particular are not subject to guardianship or other supervision,
- not use funds derived from criminal activities or other unlawful acts and the funds are at your free disposal,
- you have had the opportunity to read these terms and conditions and you expressly accept them,
- have no knowledge of the outcome of the event underlying the respective bet prior to the conclusion of the contract,
- are not a participant or other party in the sporting event on which the bet is based,
- use the <OPERATOR> Offers in their own name and for their own account and not on behalf of, representing or for the account of another,
- use the <OPERATOR> offers exclusively privately and not for commercial purposes,
- are not currently a politically exposed person, i.e. do not hold and have not been given a high public office or no member of their nuclear family is a politically exposed person in the aforementioned sense,
- are not on a United Nations sanctions list or other sanctions lists, or no member of their nuclear family is on one of the aforementioned sanctions lists,
- are not registered as blocked with <OPERATOR>, any other gambling operator or a state or regulatory cross- operator and/or cross-offer blacklist,
- you have never been medically diagnosed with problem gambling and you have not been or are not currently receiving treatment for problem gambling.
- Should there be any doubt about one or more of the above-mentioned declarations and assurances, <OPERATOR> is entitled to request further declarations and/or evidence from you directly or via the betting shop. As long as no suitable evidence has been provided, <OPERATOR> is entitled to refuse to conclude a betting contract. If a bet has already been accepted, <OPERATOR> is entitled to subsequently cancel the betting contract and to reverse the betting contract, i.e. to pay out to you only the bet stake (but not any possible winnings). This shall also apply after the end of the sporting event relating to the bet.
- A bet is validly placed when the Customer's betting application is received by <OPERATOR>'s computer centre, electronically confirmed and thus accepted by <OPERATOR>, and the Customer has received his betting confirmation (corresponding message and note in the Customer's account or handover of a betting slip in the betting shop). A bet is invalid and the bet stake is therefore to be refunded if, due to a transmission error, the date and/or time of placing the bet or the bet slip number stored in<OPERATOR>'s computer centre is demonstrably missing. The time of placing the bet as stated on the bet confirmation shall apply.
- Bets placed or accepted after the start of the underlying sporting event will be cancelled and reversed with repayment of the stake. The actual start time of the respective sporting event is decisive.
- If, following conclusion of the contract, it is ascertained that the content of the betting contract – for whatever reason – is neither determined nor determinable, the bet shall be void and the wager shall be refunded.
- A unilateral right of withdrawal by the Bettor after conclusion of the betting contract is expressly excluded. Errors or miscalculations regarding the bet or on the betting slip must be reported to the betting shop by the Bettor immediately after receipt of the betting confirmation. If both contracting parties agree that an error has occurred, the bet can be cancelled and reversed within <number> minutes after it has been placed - at the latest, however, until the start of the underlying event - in return for the return of the betting confirmation. Later complaints are excluded.
- The betting customer may not manipulate or damage the bet confirmation and is responsible for its careful storage. In the event of changes to or loss of the bet confirmation, the customer’s claim for winnings lapses and no stakes shall be refunded.
- <OPERATOR>’s records are exclusively authoritative with respect to the interpretation of the contractual content, i.e. in particular the completed bet. <OPERATOR> must disclose these records upon request. A correction of the bet and in particular of the payouts of winnings by <OPERATOR> is only permissible in the event of obvious typographical or calculation errors.
- Wager and processing fees
- The minimum wager for each bet (betting slip) is usually <currency> <amount> on the website and <currency> <amount> for bets placed in a Bet Shop. For system bets, the minimum wager per betting slip may be higher as there is an additional minimum wager of <currency> <amount> per way/combination. Depending on the location or type of bet, different minimum wagers may apply. The betting customer will be informed of this prior to placing bets.
- <OPERATOR> is entitled to levy fees and surcharges when placing bets, without the need for justification. Fees and surcharges may, for example, be levied on the betting customer to cover any betting taxes incurred for certain or all bets (in addition to the stake); such fees and surcharges are clearly shown for the customer on the betting confirmation.
- Use of <OPERATOR> offers using a customer account or a customer card
- Opening an account: The use of the <OPERATOR> offers on the website requires the opening of a customer account. You are obliged to provide correct information and personal data when registering (opening the customer account) on the website. This includes in particular your first name and surname, nationality, date and place of birth, residential address (with street, house number, postcode and town) and e-mail address. In addition, you must define an individual password consisting of at least <number> characters using upper and lower case letters, at least <number> number and at least <number> special character during the registration process. <OPERATOR> reserves the right to request further personal data from the Customer, if necessary, to the extent required for the handling of the customer relationship and/or for legal reasons. Within the scope of registration and at regular intervals thereafter, <OPERATOR> is obliged to verify and document your identity and to check it against officially prescribed blacklists.
Verification of age and identity: <OPERATOR> is obliged to verify the data you have provided, in particular your age and identity. To this end, <OPERATOR> will, in accordance with the provisions of the <OPERATOR> Data Protection Policy, transmit your data to affiliated companies of <OPERATOR> as well as third party service providers (in particular providers of online identification procedures) for the purpose of age and identity verification. The unrestricted use of <OPERATOR> offers requires a successful age and identity check.
Payment account and store it: As part of the account opening process, but at the latest prior to the first deposit to the Customer Account, <OPERATOR> is obliged to collect and store the data of a Payment Account pursuant to <Section> of the <Legal Act name>, which is set up in the name of the Customer Account Holder.
Temporary Account: <OPERATOR> reserves the right, in compliance with legal and official requirements, to set up a so-called provisional account for you until the age and identity check has been successfully completed. However, this account is limited to a maximum of <number> days from the start of the account opening and only allows limited use of the <OPERATOR> offers. Until successful age and identity verification, deposits to the customer account are limited to a maximum of <currency> <amount>; withdrawals of funds from your customer account are only possible after successful age and identity verification. In addition, after the first bet win, the customer account will be blocked for further betting as long as the age and identity check has not been successfully completed. In the event that the age and identity verification cannot be successfully completed within the aforementioned <number>-day period, <OPERATOR> is obliged to block the provisional account and any credit balance may not be paid out. If the age and identity verification is successfully completed after the <number>-day period, the blocked account may be unblocked by Customer Service.
Self-limitation: After opening an account, each betting customer has the option of setting individual daily, weekly or monthly deposit or stake limits in addition to the legally prescribed monthly stake limit (hereinafter "self-limitation"). Further details on limits and the possibility of self-limitation can be found below in section 6.
- For more convenient participation in sports betting in betting shops, <OPERATOR> offers a customer card. The issuance of a customer card also requires the opening of a customer account; the personal data to be provided for the opening of such a customer account may differ from those provided for the registration on the website. In any case, a personal identification number (PIN) must be specified in order to use the customer card in the betting shop.
- The betting customer must ensure that the personal data stored in his/her customer account, in particular the residential address and contact information, are always correct and up-to-date. In the event of changes to your personal data, you are obliged to make such changes or additions in the "<section name>" section of the website or to notify the betting shop thereof.
- The collection and processing of all personal data is carried out in accordance with <OPERATOR>'s separate privacy policy in compliance with the <country/state Act>.
- There is no legal entitlement to the opening of a customer account or a provisional customer account. <OPERATOR> may refuse to open the aforementioned accounts or make deposits into them at any time without stating reasons. <OPERATOR> is also entitled to block or delete a customer account at any time and to exclude the customer from further use of the <OPERATOR>offers if there is reasonable suspicion that a customer account is being used, has been used or could be used for illegal, fraudulent or unfair practices.
- The betting customer is solely responsible for the security of his customer account. The betting customer hereby declares that he/she treats the card number and PIN or the combination of email and password with strict confidentiality at all times and will not disclose it/them to third parties. Should a third party be able to access the customer account, regardless of whether the betting customer is aware of and/or permits such access, the betting customer shall be solely responsible for said access. <OPERATOR> shall be immediately notified of such breaches. Transactions effected via a customer account and valid PIN or password are deemed authorized. <OPERATOR> assumes no liability in this context. The same applies in the event that the customer card is lost.
- The Bettor may not open multiple customer accounts on the website. He/She is also not permitted to sell or otherwise pass on his/her customer account or possible benefits credited to this account to third parties. In the event of infringements, <OPERATOR> may at any time cancel bets placed, i.e. pay out only the bet stake and not the possible winnings to the Bettor, reclaim winnings already paid out and cancel bonuses granted.
- If no transaction has taken place on a customer account for a longer period of time (more than <number> months), the account will be set to inactive. The betting customer will be informed of this at least one month in advance using the contact details provided.
- In the event that a Customer Account is deemed inactive, <OPERATOR> reserves the right to charge the Customer Account a monthly fee of <currency> <amount> as long as the balance of the Customer Account remains positive as a result. The Bettor hereby authorises <OPERATOR> to debit the Client Account with the fee at the beginning of the following month in which the Account is considered inactive and thereafter each following month in which the Account remains inactive. <OPERATOR> will stop charging when the Account balance is zero or the Client Account is reactivated.
- In the event that <OPERATOR> declines to open the customer account or the customer account is subsequently blocked, any contractual obligations that have already arisen shall continue to be fulfilled.
- Use of the <OPERATOR> offers in a betting shop
In betting shops, bets may also be placed without the use of a customer card, provided that there are no provisions to the contrary under national law. In such a case, the betting customer must place the respective bet in cash.
- Stake limit, self-limitation and self-exclusion
- A legal stake limit per betting customer applies on the website, which may not exceed <currency> <amount> per month, unless the betting customer has been granted and set up an increased monthly stake limit by <OPERATOR> upon request. If you wish to increase the stake limit, please contact customer service.
- Limitation: In the course of opening a customer account, each betting customer is requested on the website to set an individual daily, weekly or monthly deposit or stake limit (self-limitation). If a betting customer makes use of this option, the self-set limits shall apply to the use of the <OPERATOR> offers on the website. If a Bettor wishes to reduce an existing self-set deposit or loss limit, the newly set reduced limit will apply immediately; if a Bettor wishes to increase an existing self-set deposit or loss limit, this will only apply after a protection period of <number> days. In addition, <OPERATOR> reserves the right to impose a deposit or loss limit on a betting customer if there are indications of problematic gaming behaviour. <OPERATOR> will inform the Bettor immediately of such a limit.
- A betting customer has the option at any time to have his/her customer account blocked for an unlimited period of time without giving reasons ("self-exclusion"); <OPERATOR> is legally obliged to enter a self-exclusion (the data specified in <§xx para. y> of the <Legal Act>) in the official blacklist OASIS. The customer service is responsible for setting this up; corresponding options are also available on the <OPERATOR> website. In the event of a self-exclusion, the credit balance shown on the customer account will be transferred immediately to the payment or bank account deposited. Personal data will be stored or deleted in accordance with the applicable data protection laws.
- Third-party block: <OPERATOR> reserves the right to block the customer account of betting customers for an unlimited period of time if there are indications that the respective betting customer is at risk of gambling addiction or exhibits problematic gambling behaviour (hereinafter "third-party block").
- The duration of a block is at least one year. The blocked Customer may apply for the lifting of a block in writing to <OPERATOR>after one year at the earliest. <OPERATOR> decides on this application at its own discretion; the blocked customer has no claim to the lifting of the existing block.
- Deposit / Withdrawal
- The placing of a bet on the website requires that there is sufficient credit in the customer account. Should the conclusion of a betting contract be accepted due to a technical error despite insufficient credit on the customer account, the betting contract will be cancelled (in whole or in part) and reversed.
- Deposits and withdrawals to/from customer accounts can only be made on the <OPERATOR> website from a payment account within the meaning of <§x (yz)> of the <Legal Act>, which is in the name of the customer account holder. Deposits and withdrawals via anonymous means of payment are not permitted or, in the case of payment cards issued in the name of the Bettor pursuant to <section XY> of the <Legal Act> (e.g. credit cards), are only permitted to a limited extent in terms of amount (<currency> <amount> per deposit, but not more than <currency> <amount> within a calendar month). <OPERATOR> reserves the right to charge deposit and/or withdrawal fees; in such a case, the betting customers will be informed of the obligation to pay fees. Irrespective of this, additional fees may be incurred by the payment provider over which <OPERATOR> has no influence.
- No credit interest is paid on the customer account.
- A so-called "closed loop policy" [same regulation applies for the Netherlands] applies to all payouts, i.e. payouts can only be made via the payment method that was previously used for the deposit. If the payment method used for deposits does not allow withdrawals, the withdrawal will be made to a confirmed bank or payment account of the Bettor.
- In betting shops, bets as well as deposits and withdrawals are made in cash.
- Regulations for the Prevention of Money Laundering and Terrorist Financing
- <OPERATOR> meets all requirements of the respectively applicable anti-money laundering laws. It commits to monitor all transactions in order to prevent money laundering and to report suspicious transactions to the responsible authority. In the event that the betting customer becomes aware of any suspicious activity in connection with the services of <OPERATOR>, he/she is obliged to immediately report said activity. <OPERATOR> is entitled to block or close customer accounts and freeze any credit thereon inasfar as such action is required by the <Legal Name> Act.
- In the case of any transactions in a betting shop (betting stakes, betting winnings) exceeding an amount of <currency> <amount>, <OPERATOR> or the authorised betting shop is legally obliged to identify the respective betting customer in accordance with the statutory requirements and to perform the other statutory due diligence obligations (including PEP and sanctions list comparison). If the betting customer does not yet have a customer account, <OPERATOR> will require the betting customer to register a customer account for this purpose before the transaction is carried out. The aforementioned threshold of <currency> <amount> also applies if several transactions between which there appears to be a connection together reach or exceed the amount of <currency> <amount>.
- <OPERATOR> reserves the right to also monitor transactions with lower amounts based on individual risk assessment and to run respective checks on betting customers at any time. This particularly applies in case of several smaller transactions, which are or seem to be connected.
- Determination and payment of winnings
- Winnings are calculated by multiplying the stake (minus any fees charged) by the total odds of the winning betting slip or bet combination.
- In betting shops, winnings will be paid within <number> calendar days of the occurrence of the prize event upon presentation and surrender of the original bet confirmation. Claims to winnings expire following this period. In individual cases, the payout of winnings may be postponed until the official game/race report is published, however never more than by <number> calendar days. The betting customer is not permitted to assign or pledge any winnings vis-a-vis <OPERATOR>. Winnings will only be paid out to the betting customer.
- The respective official game report or comparable publication shall be authoritative for all information for a betting event relevant for the determination of the winners, in particular for the correct result.
- Notwithstanding the aforementioned point d., for security reasons payouts which exceed <currency> <number> may be withheld for up to <number> hours after presentation of the original betting slip in order to verify the winnings claim.
- Winnings from bets placed via a customer account are credited directly to the respective customer account.
- Complaints and dispute resolution
- If you are not satisfied with our service, you can contact our support team (customer service) at any time via web chat or email to <email>. We will check your concern and get back in touch with you as soon as possible. We ask for your understanding that in individual cases it may take up to <number> weeks to process your matter.
- Alternatively, betting customers can turn to the <country/state regulator> for online dispute resolution (<Legal name>) set up by the <country/state regulator>. This platform can be reached at <URL>.
- General Betting Rules
- Priority of the specific betting regulations
For certain sports and betting variants, specific betting conditions apply in accordance with section B of these General Terms and Conditions. The Specific Betting Regulations take precedence over the General Betting Rules and must therefore be given priority by the betting customer. For other sports and/or in the event of a disagreement, the detailed rules by sports apply.
- Pricing
Changes to all odds are reserved. Adjustments to odds reflect fluctuations in the market or to the game/event development (for example, when a goal is scored). This is especially true for live betting. Changes made to odds have no effect on bets that have already been placed and confirmed.
<OPERATOR> reserves the right to suspend the odds on certain events at any time and not to accept bets on the event. In the event that a customer plays live bets, there can be no guarantee that further bets will be placed during the respective event.
Likewise, <OPERATOR> may, at any time, limit and change the amount of the maximum wager on an event.
- Winnings limit
For sports bets, there is a general winnings limit of <currency> <number> per betting slip and, in case of more than one winning betting slip, per customer and calendar day. If the sum of net winnings and wagers exceeds this amount, only <currency> <number> will be paid out. The additional amount expires, and liability for lost profits is excluded. <OPERATOR> reserves the right to set winnings limits which differ from the above winnings limit for individual sports types, competitions, events, bet types, betting shops and/or betting customers.
- Canceled, broken-off, postponed events
Void bets are settled by returning the stake. In the case of combination or system bets, this only affects the invalid bets, in other respects the combination/system bet shall stand.
A bet is considered void if it is placed on a game that is canceled, broken-off or postponed to a new starting time and the game is not restarted or continued within <number> hours. If the <number>-hour window is met, any bets shall stand. All bets made at the time of interruption or discontinuation will be settled according to the outcome at the time of interruption or discontinuation.
In the event that a tennis match is ended by walkover, all bets placed on the match will be void.
Outright bets on the overall victory or placement in a tournament, league or other competition shall be deemed void if placed on a competitor who, for whatever reason, does not compete at the event in question or if the event does not take place altogether and is not made up according to the aforementioned rules.
- Change of the event location
If a team does not play at the announced event venue, bets on the game will be held for as long as the venue is not relocated to the opponent's site (or, for international matches, as long as the venue remains in the same country). However, <OPERATOR>reserves the right to cancel all bets if it is believed that a change in venue will have a significant impact on the odds for the match.
- Errors in betting services and bet settlement
<OPERATOR> makes every effort to ensure that bets are accepted without error but is not liable for any input, transmission, system or reporting errors.
This applies in particular to:
- obvious errors by betting services, e.g. mixed-up odds, incorrect handicap specifications, typographical errors, betting services already ended
- typographical errors, e.g. when entering the odds or settling betting results.
Should such errors occur, <OPERATOR> is entitled to correct the error or to declare the bet void, to include following the end of the betting event. The odds offered at the time bets were placed on the event in question at other sports betting providers may be used as a reference and as proof of error.
- Related Contingencies
Collective/multiple bets will not be accepted if the outcome of any part of the bet contributes to the outcome of the other bet. In the event of accidental selection, the selection with the lower odds becomes invalid.
If the related selections have different end dates, the outcome with the later end date is invalid (for example, a driver wins the British Grand Prix and the same driver thereby wins the championship)
- Late Bets
Bets can only be placed on future events. If the result of the wagered-on event was already known at the time that bets were placed, bets on that event are invalid (e.g., bets on goal no. 1 after the first goal has already been scored). The same applies if the stake for the relevant bet was not paid on time.
- Settlement of bets
All bets will be settled following the end of regular match time (without overtime) unless otherwise indicated or otherwise regulated in the special betting regulations for the respective sport.
When settling bets following the conclusion of an event, the first official result announced by the official governing body immediately following the end of a match/event will be deemed final. The bet is considered decided and will be settled. This rule applies to all events, unless otherwise specified in the betting rules for a particular sport.
- any subsequent changes in results, whether due to disciplinary hearings or other reasons, will not be considered
- if the official outcome of a sporting event is not available, the result will be determined at the sole discretion of <OPERATOR> using all available evidence
<OPERATOR> reserves the right to perform a Dead Heat Reduction if more winners at an event are announced than was originally reported.
- Cash out of bets
<OPERATOR> offers the possibility to cash out bets for a variety of sports, competitions and betting markets before the underlying event(s) is completed. This enables the customer to secure profits or minimize losses in advance. Upon exercise of such cashout, the bet in question will be settled prematurely. The cashout value is displayed to the betting customer and must be confirmed by the latter. Once a cashout has been confirmed, it cannot be reversed by the betting customer. The amount of winnings then corresponds to the cashout value, which can deviate considerably from the maximum winnings calculated at the time of the bet and can also be less than the wager. The availability of the cashout function depends on various factors, in particular on the availability of the respective betting markets after bets have been placed. It is solely at the discretion of <OPERATOR> whether, when and under what conditions a cashout will be offered. The betting customer possesses no legal claim to effect a cashout, even in the event that the cashout option was available for the respective bet at an earlier point in time or would normally be expected. In the event of the non-availability of the cashout function, bets will be settled in accordance with the aforementioned point i.
- Live play information
It should be noted that data such as the current score, elapsed time and game length displayed at the terminals, on the Website or through other channels is provided by third parties and may result in delays and/or inaccuracies. Customers who rely on this data when placing bets do so entirely at their own risk. <OPERATOR> assumes no liability for (direct or indirect) damages in connection with false or delayed live play information.
- Agreements
Customers must submit their wager requests as individuals. Repeated requests with the same selections may subsequently be invalidated if <OPERATOR> believes that customers have entered into an agreement or formed a syndicate or if the relevant bets have been placed by one or more customers within a short period of time. Any attempt to effect secret agreements in the course of betting activity, or the intention to participate directly or indirectly in such an arrangement, is strictly prohibited. Likewise, the use of any tools such as scripts, bots or spiders is strictly prohibited.
- Manipulation/Irregularities
In the event that <OPERATOR> suspects that manipulation has occurred, it reserves the right, at its sole discretion, to:
- cease all or part of the betting services for the event or series of events
- block and withhold any payouts for the respective event or series of events until such time as the integrity of the event or series of events has been confirmed by the relevant sports federation
In addition, upon confirmation of event manipulation by the relevant sports federations <OPERATOR> reserves the right, at its sole discretion, to void bets placed on such events. This applies in particular if the bets were made by persons who, at the reasonable discretion of <OPERATOR>, have direct or indirect insider knowledge.
Should <OPERATOR> reasonably believe that a betting customer has, in any way, deceived <OPERATOR> itself, another customer, or any other person, including by way of payment fraud (e.g., using stolen credit cards), prohibited transactions (e.g., money laundering) or other fraudulent activity, <OPERATOR> shall be entitled to exclude such customer from the use of all <OPERATOR> services, to withhold winnings and credits in whole or in part, and to communicate information (together with the customer's identity) to the police and other relevant authorities. The same applies if a customer violates these Terms and Conditions.
- Unauthorized Bettor
Bets on events or a series of events (such as league or cup competitions) in which the betting customer himself participates as an athlete or coach or acts as the owner or official of a participating club are not permitted. The same applies to bets placed on behalf of a person participating or involved in this sense. In the event of a breach of this rule, <OPERATOR> reserves the right to refuse to pay out any winnings and paid wagers and to declare the bets invalid such that only the wager need be repaid. It this connection, it is immaterial whether <OPERATOR> could or should have known that a betting customer is an involved person in the above sense. Accordingly, <OPERATOR> may, at any time, withhold or recover funds and report the relevant betting activities to the responsible sports federations and/or authorities after <OPERATOR> has become aware of an unauthorized Bettor or a related person.
- Liability, damages, set-off
- Claims by the customer for damages are excluded, in particular those caused by system failures, errors in the betting software used, manipulated, incorrect or delayed data transfers, etc. <OPERATOR> does not warrant that data transmitted between <OPERATOR> and the Player via the internet will be transmitted completely and without interruption. <OPERATOR> expressly disclaims any liability for any injury to the Player with respect to bets, including any pecuniary loss, which results from data transmission errors or circumstances beyond <OPERATOR>’s control, or from data which is incompletely transmitted or which was disrupted during transmission.
- Excluded are customer claims for damages resulting from injury to life, body, or health, or from the breach of essential contractual obligations (material obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by <OPERATOR>, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the objective of the betting contract.
- In the event of a breach of essential contractual obligations, <OPERATOR>’s liability is limited to the lesser amount of the wager placed or the net winnings. Alternatively, where relevant and applicable, liability is limited to the amount in the Player's account or the amount transferred to or from the Player's account, whichever is less. In no event shall <OPERATOR> be liable for any indirect or consequential damages (including losses and winnings), even if <OPERATOR> was informed in advance of the possibility of such damages.
- The betting customer may only set off claims by <OPERATOR> if the Bettor’s claims have been legally established as final and absolute or explicitly acknowledged.
- Severability
In the event that any of the above or below provisions should be or become wholly or partially ineffective, the remainder of these provisions and the validity of the betting contract shall not be affected. Insofar as individual provisions may be ineffective, the content of the betting contract which replaces this provision shall be governed by the statutory permissible provisions that most approximate the ineffective provisions.
- Legal venue
All legal disputes arising or existing between a betting customer and <OPERATOR> in connection with the use of the <OPERATOR> offers shall be governed exclusively by <country/state> law, excluding the conflict-of-law rules of private international law and the<country/state> UN Convention on Contracts for the International Sale of Goods. Excluded from this choice of law are the mandatory consumer protection provisions of the country in which the betting client has his habitual residence. As far as permissible, the place of jurisdiction shall be the registered office of <OPERATOR> (<country/state>).
- Priority of language
These Terms and Conditions and other texts on the websites may be published from time to time in various languages. Translations into other languages are done as a service to the Player and as a gesture of goodwill. However, in the event of ambiguity or discrepancies between the <language> version and a translation, the <language> version shall solely be authoritative.
- Special Section
Certain sports and betting markets have special rules and regulations. The betting client must first observe the specific rules of the various sports, as these have priority over the General Betting Rules. For the sake of clarity, an overview is presented below, listing the specific betting regulations for the most popular sports. For other sports and/or in the event of a disagreement, the detailed rules by sports apply.
