Holland Casino Terms &Conditions

These general terms and conditions regulate the usage of games and play provided through hollandcasino.nl, managed by Holland Casino.

1. Definitions

1.1. In these terms and conditions, the following terms, indicated with a capital, whether single or plural, will have the following meaning:

Account means the personal online gaming account created by a Player on the Website in order to use and participate in Games offered by Holland Casino on the Website.

CRUKS means the Central Gambling Exclusion Register ( Centraal Register Uitsluiting Kansspelen) a tool to facilitate the process of voluntary and involuntary exclusion from games of chance. A player can self-register in CRUKS and the Netherlands Gambling Authority can register a Player voluntarily or involuntarily. Before the start of Gaming, Holland Casino must check whether the Player is registered in CRUKS.

Customer Service means Holland Casino´s customer service available to Players via the contact details on the Website.

Game Rules means specific rules that apply to each Game available on the Website or that can be requested from the Customer Service.

Games means the online games of chance provided by Holland Casino via the Website.

Holland Casino means Holland Casino N.V. established and existing under the laws of the Netherlands, having its registered office in (2132 JP) Hoofddorp, the Netherlands, at Neptunusstraat 71, registered with the Chamber of Commerce under 68662289.

Player means the natural person that registered for an Account via the Website in order to participate in Games.

Terms and Conditions means the underlying general terms and conditions that apply to Players who registered for an Account on the Website and who wish to participate in Games offered by Holland Casino on the Website.

Website means www.hollandcasino.nl including, if applicable, any mobile and mobile application version thereof. References to the Website in these Terms are both a reference to hollandcasino.nl and Holland Casino's offered app(s), unless otherwise stated.

2. General

2.1. These Terms and Conditions apply to Players who wish to set up an Account on the Website or who wish to participate in Games offered by Holland Casino on the Website.

2.2. When creating an Account on the Website, the Player enters into a contract with Holland Casino, to which these Terms and Conditions apply.

2.3. Holland Casino reserves the right to modify the Terms and Conditions at any time, including, without limitation, to comply with applicable laws and regulations, as well as other regulatory requirements. Whenever a substantial amendment to the detriment of Player is made to the Terms and Conditions, Holland Casino will notify the Player via a notice on the Website upon Account login and prior to the changes coming into effect. Upon being notified, the Player will be required to re-confirm its acceptance of Terms and Conditions. If the Player does not agree to the updated Terms and Conditions he will no longer be able to use the Account or to participate in Games.

2.4. It is the sole responsibility of the Player to review these Terms and Conditions, including the specific Game Rules for each Game the Player chooses to participate in.

2.5. In offering the Games Holland Casino may make use of third party software providers. Separate End User License Agreements (“EULA’s”) may apply to the use of the third party software. The EULA for Playtech is attached to this Terms and Conditions.

2.6. Additional terms and conditions might apply for Games which are offered by Holland Casino’s gaming network(eg Ipoker and Bingo).These terms and conditions will be made available for your acceptance before entering the respective game environment.

3. Account Registration

3.1. In order to participate in Games, the Player is required to register for an Account on the Website.

3.2. The Player may only register for one Account on the Website. Holland Casino has the right to block any duplicate Account.

3.3. Persons below the age of 18 are not allowed to register for an Account and to participate in the Games.

3.4. The Player is obligated to provide the limits of its gaming behaviour and its expected scope of play with regard to Games, such as the maximum duration of access to the player interface per day, week or month; the maximum amount of deposits to the Account per day, week or month; and the maximum available credit balance on the Account.

3.5. The Player warrants that all information provided upon Account registration is true, accurate, and complete, and corresponds to the name(s) appearing on the credit card and/or bank account used for the deposits and payments of gains.

3.6. Holland Casino shall not register a person as a Player or may terminate an already existing Account if Holland Casino has learned, knows or suspects that the conditions referred to in Clauses , 3.4 and/or 3.5 are or have become incorrect, inaccurate, false or incomplete.

3.7. Holland Casino shall not register a person in case of a reasonable suspicion that the person as a result of excessive participation in Games or because of a game addiction may cause damage to itself or to its relatives

3.8. Holland Casino is entitled to implement measures to ensure that the limits referred to in Clause 3.4 cannot be exceeded.

3.9. Upon registration, Holland Casino verifies whether the Player is registered in CRUKS. Players who are registered in CRUKS are not permitted to play Games or to register for an Account.

3.10. Registration as a Player must be done by providing a username and password as well as personal information such as name, date of birth, place of birth, address, email address, telephone number, citizen service number (burgerservicenummer; BSN), the bank account number and other information required during the Account registration.

3.11. Holland Casino is required to verify the identity and contact details of a Player when registering for an Account. The Player shall provide Holland Casino with all relevant (personal) information and documents requested by Holland Casino for such purpose. If there are discrepancies between the information provided by the Player, the Account will not be activated

3.12. Holland Casino validates the Player´s citizen service number ( burgerservicenummer; BSN) in the Dutch BSN register. If there are discrepancies between the information provided by the Player and the information appearing in the BSN register, the Account will not be activated.

3.13. Holland Casino shall register the Player´s Account after it has established that there are no objections to registration of that Player based on the applicable rules and regulations, including but not limited to the Wet ter voorkoming van witwassen en financiering van terrorisme and the Sanctiewet 1977.

3.14. It is the Player's own responsibility that all (personal) information provided in connection with the Account registration is correct and is kept up to date. If there are changes in the information provided by the Player in connection with the Account, the Player is obliged to amend its personal information in the Account via the Website or by contacting the Customer Service immediately. It is the Player's responsibility to verify that any changes made are correct.

3.15. Missing or incomplete information could mean that a selected action cannot be carried out, including that the Player is not able to participate in the Game, or that funds cannot be paid into the Player's bank account. Furthermore, the winnings become obsolete in all cases in accordance with the relevant Game Rules.

3.16. When registering as a Player with Holland Casino, the Player is automatically associated with a digital playing card to the Account. The playing card is used in accordance with Holland Casino's current terms and conditions for playing cards.

3.17. An Account may only be held by a natural person Accounts are not transferable, and it is prohibited for Players to sell, transfer or acquire Accounts from other Players.

3.18. The Player is obliged to store and use the login information, username and personal password of its Account in a safe and secure way. The Player is responsible for all use and transactions made with its Account. If the Player suspects that unauthorized use is being made from its Account, the Player must immediately contact Holland Casino. Holland Casino is not responsible for any abuse or misuse of the Account by third parties due to the Player´s disclosure, whether intentional or accidental, of the Account login details.

4. Account deposits and withdrawals by Players

4.1. In order to participate in Games, the Player must transfer money to its Account. The Player is allowed to have only one contra account with regard to its Account. All payment transactions between the Player and Holland Casino will exclusively take place via the Account.

4.2. The Player guarantees that it will only use debit or credit cards and other financial instruments that are valid and lawfully belong to such Player.

4.3. All funds transferred by the Player to its Account are segregated from other company funds and are held in separate designated bank accounts. In the event Holland Casino has been granted suspension of payments or is declared bankrupt these funds are protected by a foundation set up by Holland Casino for that purpose.

4.4. No interest is earned on funds held in the Account.

4.5. The Account of a Player will only be credited by Holland Casino, with the exception of corrections due to technical issues, with:

4.5.1. money coming from the contra account of that Player or via payment instruments methods specified by Holland Casino on the Website, as may be amended from time to time;

4.5.2. money which is the result of winnings of Games; or

4.5.3. money which is the result of free credits provided to that Player.

4.6. Holland Casino shall charge a Player's Account only to the benefit of that Player's contra account; for the purpose of that Player's participation in the licensed games, or to the benefit of its own bank account. Holland Casino shall only debit an Account in favour of the Player's contra account after the Account has been credited with funds from that contra account.

4.7. Holland Casino shall debit the Account in favour of the contra account if requested by the Player, to the extent that the balance in the Account exceeds the maximum specified by the Player in his Account or upon Account termination. The foregoing does not apply as long as the Player's Account and opportunity to participate in Games have been suspended in accordance with these Terms and Conditions and/or applicable laws and regulations, based on a reasonable suspicion that the conditions for Account registration are not or are no longer being met.

4.8. Any expense related to withdrawal requests shall be borne by Holland Casino Online.

4.9. The Player is not allowed to have a negative balance on the Account nor is the Player allowed to participate in any Game if the balance on his Account is insufficient for that purpose.

4.10. Holland Casino is entitled to monitor all transactions to prevent money laundering and to take any measures to obtain the identity of a Player and to verify such. If such identification and verification is not obtained, or where Holland Casino knows or suspect that the transaction may be related to money laundering or the funding of terrorism, Holland Casino may not proceed with such transaction and shall have the right to terminate such Player’s Account and to take all reasonable measures, including the notification of any suspicious transactions to the relevant competent authorities.

4.11. Holland Casino shall provide the Player, on the publicly accessible part of the gaming interface and on the Player interface, with access to general information relating to the manner and conditions of payment transactions with the Player.

5. Participation in Games

5.1. Holland Casino is licensed and regulated by the Netherlands Gambling Authority (Kansspelautoriteit) to offer Games under licence reference number 1610/01 247085.

5.2. The Player may participate in Games in its personal non-professional capacity, reasons only and in accordance with applicable laws, rules and regulations.

5.3. Holland Casino has the right to cancel and refuse bets if there is a suspicion of abuse. Holland Casino is also entitled to cancel bets due to technical problems or due to any other foreseen/unforeseen circumstances or circumstances, whether or not within the control of Holland Casino. Any winnings obtained from a malfunctioning Game shall be considered void.

5.4. The Player is solely responsible for reporting his winnings and losses arising from Games to the extent required by the local (tax) law.

6. Game addiction prevention

6.1. Holland Casino shall systematically record and analyse data relating to the Player's gaming behaviour. If there is a reasonable suspicion of addiction to Games, Holland Casino shall investigate the Player's behaviour in a personal interview with that Player.

6.2. If, after the investigation referred to in Clause 6.1, Holland Casino reasonably suspects that the Player can cause damage to itself or to its relatives by excessive participation in Games or game addiction Holland Casino shall recommend that that Player be temporarily excluded from participation in Games and all other games of chance, whether online or offline, by registration in CRUKS.

6.3. If the analysis referred to in Clause 6.1 indicates that there is an excessive level of participation in Games or a risk of addiction to Games, Holland Casino may take appropriate intervention measures to prevent excessive participation and addiction to Games, such as:

6.3.1. Provide the player with insight into his playing behaviour by means of an interview, and point out to him in particular any identified excessive or risky playing behaviour;

6.3.2. Advise the Player to make use of a facility that enables the Player to gain insight into its playing behaviour;

6.3.3. Advise the Player to make use of the possibility to limit his access to the Games in accordance with a maximum duration per visit or Account login to be determined by that Player, or during certain time blocks to be determined by that Player;

6.3.4. To limit the Player's access to the Games without its consent to a maximum duration per Account login or during certain time blocks;

6.3.5. Advise the Player to make use of the possibility to exclude himself for a definite or indefinite period of time from participation in the Games;

6.3.6. Exclude the Player without his consent from participation in the Games for a definite or indefinite period of time;

6.3.7. Call or email the Player, or send the Player (pop up) messages through the player interface, to alert the Player of its playing behaviour.

6.4. Holland Casino shall ensure that an effective addiction prevention policy is developed, implemented and maintained within its organisation.

7. Blocking, suspending and/or closing Accounts

7.1. These Terms and Conditions are effective, and binding upon the Player, from the moment of acceptance, and shall remain in force unless the agreement between the Player and Holland Casino is terminated in accordance with the provisions hereof.

7.2. The player can terminate its Account by contacting the Customer Service at any time. The closure of the Account corresponds to the termination of the agreement between Holland Casino and the Player to which these Terms and Conditions apply.

7.3. Holland Casino may terminate an Account at any time and without notice, if there is a breach of the provisions of these Terms and Conditions, or the Account has not been accessed for twelve (12) consecutive months, or there is another ground for contractual invalidity, at the sole discretion of Holland Casino.

7.4. Holland Casino may at any time terminate the Account with one (1) months prior notice.

7.5. Upon termination, the Player's funds on the Account are transferred to the Player's corresponding bank account, after any ongoing Games have ended.

7.6. In addition to the grounds for termination stated in article 7.2 und to and including 7.4, Holland Casino may block or suspend the Player's Account (and/or, as the case may be, restrict the Player’s deposit options, or cancel settled Games and block, suspend or retrieve prizes, winnings and disbursed funds) and/or terminate the Account upon finding or suspecting one or more of the following:

7.6.1. the Player's gaming pattern - in Holland Casino's assessment - has the character of inappropriate gaming behaviour;

7.6.2. Encouragement or complicity in cheating, including conspiracy, fraud, deception, or other illegal activities;

7.6.3. Bet on sporting events in which the Player himself participates, for example as an athlete or referee, or in any other way can influence the outcome of the event;

7.6.4. Bet on betting from bookmakers and people in similar positions;

7.6.5. Abuse of insider knowledge and attempts at odds manipulation or match-fixing;

7.6.6. Money laundering or terrorist financing;

7.6.7. Game play of the Player against himself;

7.6.8. Violation of applicable chat rules ;

7.6.9. Attempted hacking of the Account or other Players' Accounts;

7.6.10. Syndicate Games and similar actions performed in agreement between multiple Players;

7.6.11. Systematic betting on delayed odds movements in relation to market movements;

7.6.12. Systematic betting on erroneous odds and utilization of bet delays;

7.6.13. Use of applications, robots or the like to influence or automate the Game and the associated functionalities;

7.6.14. Abuse of the Player's Account;

7.6.15. Use of other Players' Accounts, contact, personal and/or login information;

7.6.16. At the request of the police, court or regulatory authority;

7.6.17. Holland Casino is, for whatever reason, no longer able and/or allowed to offer the Games;

7.6.18. Other inappropriate behaviour which, in the opinion of Holland Casino, is contrary to the intention of the Game and the associated functionalities.

7.7. Unless a legal provision requires otherwise, Holland Casino shall suspend the opportunity to participate in the Games:

7.7.1. at the Player's request;

7.7.2. in case of a reasonable suspicion that the conditions for Account registration are not or are no longer met; or

7.7.3. in case of a reasonable suspicion that the Player by excessive participation in Games or Game addiction may cause damage to itself or to its relatives.

7.8. In cases as referred to in Clause 7.7.2. and 7.7.3., Holland Casino shall investigate the justification of such suspicion. The possibility to participate in the Games shall be suspended for the duration of the investigation, with a maximum of six (6) months.

7.9. Holland Casino may at any time block the Account if Holland Casino finds this necessary for technical or security reasons.

8. Data Protection

8.1. In order to provide Players with access to the Account and Games, Holland Casino has to process personal data of the Player within the meaning of the General Data Protection Regulation (GDPR). Information on how Holland Casino uses and shares personal data in included in the Privacy Policy.

9. Limitation of Liability

9.1. Holland Casino shall not be liable for any loss, costs, expenses or damages, whether direct, indirect, consequential, incidental or otherwise, arising in relation to any technical failures of the Websites and/or participation in the Games, including but not limited to loss or damage of data, loss of profit, loss of benefits, or loss of savings, unless it is proven that the technical failure is attributable to Holland Casino in which case Holland Casino's liability shall be limited to the direct damages Player has demonstrably suffered as a direct result of the attributable failure, limited to an amount not exceeding ten thousand euros (EUR 10.000,--.) .

9.2. Holland Casino is entitled to remove any Game from the Website at any time at its sole discretion and reserves the right to make changes or amendments, to alter, suspend or discontinue any element of the Website, the Account and/or the Games.

9.3. Holland Casino does not accept any liability for any failures or issues that arise from Player equipment, Internet connection or third-party provider.

9.4. Holland Casino is not responsible for circumstances beyond Holland Casino's control, including unpredictable and external events as well as any measures, decisions, regulations and legislation of regulatory authorities and/or the government , as a result of which communication to and from Holland Casino's systems cannot be carried out and/or Games cannot be accessed and/or played. The Game Rules may address how interruptions of ongoing Games are being handled.

9.5. Holland Casino is not responsible for any losses due to temporary or permanent closing of the Account.

9.6. The Player indemnifies, defends and holds Holland Casino harmless against all claims, liabilities, damages, losses, costs and expenses including legal fees, arising out of any breach of these Terms and Conditions by the Player or any other liabilities arising out of the access and use of the Account (whether or not by the Player) and/or the Website.

10. Intellectual Property Rights

10.1. All intellectual property rights, including copyrights, trade mark rights, patent rights, design rights, trade name rights, database rights, and neighbouring rights, as well as rights to knowhow, relating to the Website, Games and Account, including but not limited to the domain name, software, design, layout, structure and organization of the contents of the Website, and any material reproduced therein and/or made available, such as photographs, images, illustrations, texts, video´s, audio, logos and trademarks, or any other content made available through the Website (collectively “Content”) are owned by Holland Casino and/or its licensor(s).

10.2. The Website is solely for private, personal and non-commercial use, and the Content on the Website is presented for information and/or promotional purposes only.

11. Customer Service

11.1. The Player may address all questions and complaints to the Customer Service, free of charge.

11.2. The Customer Service shall register Player complaints within 72 hours of their receipt. In doing so, the Customer Service shall record at least the contact details of the complainant, the date of receipt of the complaint and the subject and content of the complaint.

11.3. The Customer Service shall register the processing of a complaint within 72 hours of registration and record at least within which period the complaint was handled, how the complaint was handled and the result of the complaint.

11.4. The Customer Service shall confirm receipt of a complaint to the Player no later than 72 hours after receipt of the complaint.

11.5. The Customer Service shall not be obliged to process a complaint if it relates to conduct about which the Player has previously lodged a complaint and which was dealt with in accordance with the procedure referred to in this Clause 11.

11.6. If the Customer Service decides not to handle a complaint, the Customer Service shall inform the Player of this within one week of receiving the complaint.

12. Limits

Holland Casinos considers safe, fair and responsible gaming to be paramount. Limitations play an important role in this, because they help you to be aware of the game. The following limitations apply:

Deposit limits

- If you choose a daily deposit limit it will be up to EUR 15,000.
- If you choose a weekly deposit limit it will be up to EUR 95,000.
- If you choose a monthly deposit limit it will be a maximum of EUR 380,000.
- Young adults (persons between 18 and 23 years old) have a maximum monthly deposit limit of EUR 400.

Play time limits

- If you choose a daily play time limit, this limit will be a maximum of 8 hours or 480 minutes.
- If you choose a weekly playtime limit, this limit will be a maximum of 56 hours or 3360 minutes.
- If you choose a monthly playtime limit it will be a maximum of 224 hours or 13440 minutes.

Playtime limits are calculated from the moment of first participation in a game.

The above mentioned limits apply to all games offered including poker. If you are still participating in a tournament after 8 hours, you can of course finish the tournament. However, you will not be able to re-enter the tournament or cash out any outstanding re-buys.

Automatic Withdrawal Limit

There is an automatic withdrawal limit threshold of up to EUR 99,999.

13. Applicable law and jurisdiction

13.1. These Terms and Conditions are governed by Dutch law.

13.2. Any complaints regarding Holland Casino and/or its services, may be submitted with the Customer Service according to the instructions located on the Website.

13.3. The European Commission provides for an online dispute resolution platform, which can be accessed here: https://ec.europa.eu/consumers/odr/ .

13.4. All controversies, disputes or claims arising out of or relating to the Terms and Conditions and/or (the use of) the Games or Account will be exclusively and finally settled by the competent civil court the Netherlands.
